These Terms of Service ("Terms") govern your access to and use of the MyDashboardPro platform, applications, and services (collectively, the "Services"), operated by MyDashboardPro ("Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Use of the Services

You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

Account Registration

To use certain features of the Services, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or suspected breach of security.

Acceptable Use

You agree not to misuse our Services or help anyone else do so. Specifically, you agree not to:

  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
  • Attempt to gain unauthorized access to the Services or their related systems or networks.
  • Upload or transmit harmful code, viruses, or illegal material.
  • Reverse engineer, copy, or create derivative works from the platform.

2. User Content and Data

You retain all rights to the data, information, and material you submit to the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, and display the User Content strictly as necessary to provide the Services to you.

3. Payment and Subscriptions

Access to certain features of the Services may require a paid subscription. You agree to pay all applicable fees associated with your subscription plan.

  • Billing: Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) depending on the plan selected.
  • Cancellations: You may cancel your subscription at any time, but no refunds will be provided for partial months or unused time unless legally required.

4. Limitation of Liability

To the maximum extent permitted by law, MyDashboardPro and its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services.
  • Any conduct or content of any third party on the Services.
  • Any unauthorized access, use, or alteration of your transmissions or content.

Operational and Labor Compliance: MyDashboardPro provides software tools for operational oversight and scheduling. However, you acknowledge and agree that MyDashboardPro is not responsible for your compliance with local, state, or federal labor laws, payroll regulations, health codes, or licensing requirements. It is your sole responsibility to ensure that your business operations comply with all applicable laws.

5. Termination

We may suspend or terminate your access to the Services at our sole discretion, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or request account deletion through our support channels.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
